Drug Crimes

This is another one of the most common cases in the criminal justice system, both in Montgomery County and throughout Texas. We handle multiple drug cases every day and the defense to a drug charge needs to be tailored to every individual.

Most drug charges begin with a traffic stop. So, the most important thing an experienced lawyer will do when evaluating a drug case is to make sure that the initial stop was legal. Often people just believe that the officer must have pulled them over for a valid reason, but that is not necessarily the case. We watch the traffic stop video for every one of our clients to make sure that the police had a right to pull them over before we will ever agree to any type of plea. If we do not feel like the police acted lawfully, we will immediately file a motion to suppress to ask the court to throw the charge out.

The second step in evaluating a traffic stop leading in a drug arrest is to make sure the officer searched the vehicle legally. An officer must have probable cause to search a vehicle and what they think is probable cause and what the law says is probable cause is often very different. Again, if we believe the officer didn’t have probable cause to search then we will file a motion to suppress and ask the court to suppress the drug evidence which can essentially end the case.

Alternatively, if the police did everything right then we need to tailor our strategy to the client and determine what the best outcome for them is under the law. Whether that ends in a time served conviction, some sort of probation or even substance abuse treatment. We will do everything in our power to negotiate and or fight for what our client wants to see happen in their case.
