Simple assault is a class A Misdemeanor and is defined in Texas as when someone knowingly, intentionally, or recklessly causes an injury to another. It is common for people to not understand why they are charged with this crime when the other person seems fine and did not suffer a major injury. Unfortunately, the definition of injury just means the other person felt pain, so there is no need to prove serious injury to charge someone with this crime.
On the other hand, assaults involving a family hold many more consequences than a simple assault. Essentially these cases have the same elements as a simple assault but involve a family member or member of the same household. The consequences for these cases can lead to future felony charges as well as impact your right to legally own and possess firearms.
Then there are assaults that cause serious bodily injury and assaults involving a deadly weapon which are very serious felony charges that can result in years of incarceration if not handled properly.
All assault cases must be handled by someone who has experience in the various defenses to these offenses such as self-defense, protection of third party or mutual combat.
